The Duty of Candour is a legal requirement in Scotland that ensures people are informed, supported, and treated fairly if an unexpected or unintended incident occurs during their care.
What Is the Duty of Candour?
The Duty of Candour is a legal duty under Scottish law that requires healthcare providers to:
- Be open and honest with clients when things go wrong
- Apologise when harm has occurred
- Explain what happened and why
- Offer support and reassurance
- Review what went wrong to reduce the risk of it happening again
When Does the Duty of Candour Apply?
The Duty of Candour applies if a client experiences an unexpected or unintended incident during treatment that results in:
- Physical or psychological harm
- The need for additional treatment
- Ongoing or prolonged symptoms
- Significant distress
Not all complications or side effects trigger Duty of Candour — only those that meet the legal threshold under the regulations.
What We Will Do If an Incident Occurs
If the Duty of Candour applies, Tweed Aesthetics will:
- Inform you as soon as reasonably possible
- Offer a sincere apology
- Provide a clear explanation of what happened
- Explain any further care or treatment required
- Offer appropriate support, including signposting if needed
- Carry out a review or investigation of the incident
- Take steps to learn from the incident and improve safety
All discussions and actions will be handled with sensitivity, respect, and confidentiality.
Your Rights
You have the right to:
- Receive honest and timely information
- Ask questions and receive clear answers
- Be supported throughout the process
- Make a complaint if you are unhappy with how an incident has been handled
Recording & Reporting
All Duty of Candour incidents are:
- Documented appropriately
- Reviewed as part of our clinical governance processes
- Included in an annual Duty of Candour report, as required by law
This helps ensure accountability and continuous improvement.
Complaints & Further Support
If you have concerns about your care, we encourage you to raise them directly with us in the first instance. We take all concerns seriously and aim to resolve them promptly and fairly.
If issues cannot be resolved, you may escalate concerns in line with Healthcare Improvement Scotland guidance.
